TERMS AND CONDITIONS
BY PAYING FOR A PROGRAM, COURSE, OR SERVICE EITHER IN PARTIAL OR IN FULL, YOU AGREE TO THE TERMS BELOW:
You agree to enter into this Coachingemily Agreement with Emily Hodge (the ‘company’or ‘we/us’) Emily Hodge (the “Coach”), then this Participant Agreement (the “Agreement”) automatically becomes a binding contract between you and the Company, and applies to your participation in the program. By paying for this service, course, or program, you agree to these Terms and Conditions, without modification, and acknowledge reading them.
CREATING, RE-ARRANGING AND CANCELLATION OF APPOINTMENTS
- For group online programmes (e.g. How to Lead a Gentle Life) dates are pre-set and arranged as per the course schedule
- For Workshops/Speaking engagements/Coaching creating appointments will usually be carried out using an online scheduler
- If client need to re-arrange or cancel an appointment this must be requested at least 24hrs before the original appointment date
- If the request to re-arrange is within 24hours of the appointment date, full cost will be charged of the original date unless exceptional circumstances are present such as unforeseen illness or difficulties
- For the coach, in exceptional circumstances such as illness or difficulties, she reserves the right to re-arrange or cancel an appointment at any time. This will be done with the greatest notice and all appointments re-scheduled or refunded where this is not possible within an appropriate time limit
CONFIDENTIALITY & RIGHTS
- All client conversations are confidential
- In line with health and safety executive and BPS terms and conditions (to whom Emily Hodge belongs), the conditions under which confidentiality could be broken is where client is deemed to be at a risk to themselves or others
- If confidentiality were to be broken, this would always be discussed with the client prior to Emily Hodge taking action
- Under the terms of the Data Protection Act 1998, the Coach will keep on record basic client information (e.g. contact details) as is necessary
- Client understands that the confidentiality of others on a group programme (e.g. How to Lead a Gentle Life) is paramount and anything shared in the group environment is kept confidential
- All client notes remain unidentifiable, remain on a locked computer and are only accessible by the Coach
PAYMENTS & BILLING
- Initial half-hour consultation is complimentary
- Rates are allocated by the hour, a day rate or by package supplied
- Invoices are to be settled prior to programme materials being shared (in the case of ‘How to Lead a Gentle Life’), prior to package delivery (in the case of one to one coaching services) and prior to or within 7 days of invoice receipt for all other coaching or support services
- Payment to be made by PayPal or direct bank transfer
CLIENT EXPECTATIONS
- Client commits to full participation in their programme, course, or coaching sessions
- Client understands that they are 100% responsible for their own progress and results
- Client understands that results are expected, however they cannot be guaranteed
- Client understands that results will vary depending on their need, desire for change, commitment and other internal or external factors which the coach is committed to working with the client on
- Client understands they are at liberty to discuss any of the above with the coach herself to ensure the best progress can be reached for the client and results are achieved to their expectations
COACH EXPECTATIONS
- The Coach guarantees to do her best work possible
- The Coach will not be liable for adverse changes that occur as a result of the coaching process
INTELLECTUAL PROPERTY
- Any information or materials clients share within group programmes remains the ownership that client
- All materials, tools, creative ideas and leadership formats of workshops, speaking engagements, coaching and group programme ‘How to Lead a Gentle Life’ remain the sole ownership of the Coach, Emily Hodge and cannot be used in any other way
- Use of the Coach’s materials is an infringement of intellectual property
- You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of the Site or Program content or intellectual property, in whole or in part, without our prior written consent. We reserve the right to immediately remove you from the Program, without refund, if you are caught violating this intellectual property policy
- The Coach reserves the right to ensure their material is not used in any of the above ways
PROGRAM DESCRIPTION
- We endeavour to describe and display programmes, coaching sessions advertised, packages and pricing as accurately as possible
- The client understands that changes to programmes, coaching sessions advertised, packages and pricing may change at any time
- Where errors or changes are required these are changed at the discretion of the Coach an can be subject to change at any time
- The Coach is qualified and insured to provide coaching services, therapy in the form of NLP, EFT, CBT and listening skills as a result of a BSc in Psychology, MSc in Health Psychology and a Diploma in Coaching and NLP
- Coaching itself is not clinical psychology, counselling nor psychotherapy and should not be seen as replacement
- The Coach will discuss with you your needs and requirements and support you to get the support you need if coaching is not appropriate at this time
- Circumstances under which coaching may be inappropriate include where client is having a psychological breakdown and where they are unable to engage in services to plan for their future
REFUNDS
- Should you be unhappy with a service, in the first instance please raise this on email with your coach to resolve the issue quickly and efficiently
- Should you continue to be unhappy please refer below to which services are liable for further action or refund
How to Lead a Gentle Life Course
- If after the first week of the program client is not happy and they have discussed it with the Coach, with attempts to resolve it, Client is eligible for a refund
- This request must be submitted in writing within 5 days of the starting week
Gentle life Hub Membership
- Cancellation of membershipIf you feel The Gentle Life Membership Hub isn’t for you, there’s an easy way to pause or cancel your membership. This will be via the membership dashboard when it is finalised. Until then, all you’ll need to do is email emily@coachingemily.wpengine.com to let me know you’d like to cancel and I will do that for you right away. I hope this makes it easy for you because I feel confident you’ll want to stay.RefundsThe Gentle Life Membership Hub has a monthly subscription option. Because of this short-term access, there’s a no refund policy on monthly memberships. You can always stop or pause your membership any time you wish.
For a refund on Annual Memberships, all you need to do is email emily@coachingemily.wpengine.com within 30 days of joining to let me know you’d like to cancel and you’ll receive the rest of your membership cost back. After 30 days there is a no refund policy.
Workshops/Speaking engagements/Coaching
- For private coaching, if the coachee is unhappy with the coaching agreement and process up to and as part of the first official session, a refund may be discussed
- It is not possible to provide a refund on other services, or after the first coaching session for private coaching, unless very exceptional circumstances are present which must be discussed with the coach and if necessary a third party upon arrangement
LIMITATION OF LIABILITY
- We shall not be liable to you (excluding for personal injury or death, fraud, or wilful default) for any loss or damage (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, and whether in tort (including without limitation negligence, contract or otherwise) that may result in connection with the Services
- The Coach is not liable for damages in connection with (I) any failure of performance, error, omission, denial of service, attack, interruption, deletion, defect, delay in operation or transmission, computer virus, or line or system failure; (II) loss of revenue, anticipated profits, business savings, goodwill or data; and (III) third party theft of, destruction of, unauthorized access to, alteration of, or use of your information or property regardless of our negligence, gross negligence, failure of an essential purpose and whether such liability arises in negligence, contract, tort, or any other theory of legal liability
- Our liability to you shall at all times be limited to the amount paid, if any, by you for the Services
Please note that if there are any areas of the above terms and conditions that you are not comfortable with please advise me before going ahead – we want happy conditions to thrive in always.
